IVA's
An Individual Voluntary Arrangement is ideally suited to those in regular employment who wish to avoid the distress of bankruptcy but who have debts in excess of £15,000. A legally binding agreement on all parties, an IVA is an agreement between you and your creditors whereby you agree to pay what you can afford to pay over a 5 year period. Any debt outstanding outside of that agreement is automatically written off. Under the terms of an IVA your creditors cannot continue to chase you for money, but you have to keep up the payments for the agreed period otherwise they could in theory bankrupt you.
Debt Management
A Debt Management Scheme is not a legally binding agreement, but a voluntary agreement established between the various parties. Many companies can offer you free and impartial advice and help with your debt problems. If you are struggling with debt, then a Debt Management Scheme can help you regain control of your finances.
Bankruptcy
While Bankruptcy is always an option for those with serious debt problems, it is not a course of action which should be taken lightly. However, for some it is the only option. Bankruptcy is a legal status which enables an individual to clear their entire debts in one fell swoop. A bankruptcy petition can be declared by any creditor who is owed in excess of £750, or by the individual themselves. Bankruptcy usually lasts for a period of one year.
